It had to happen sooner or later—that is, once again seeing “deflategate” in the headlines.
Thursday afternoon marked the continuation of deflategate as the NFL’s appeal on Judge Richard Berman’s September decision took place. Just around six months ago, Berman made the decision that freed Tom Brady just in time for New England’s season opener. Patriots fans were left praising him as Roger Goodell’s four-game suspension placed on Brady was lifted.
Unfortunately, Thursday’s appeal by the NFL on Berman’s September ruling has left the fate of deflategate in question and things do not necessarily look promising. In short, Tom Brady’s attorney, Jeremy Kessler’s argument fell week, judges, Robert Katzmann, Barrington Parker Jr., and Denny Chin were seemingly unconvinced to side with Brady going forward, and, once again, Brady’s destroyed cell phone is seemingly still an issue that is influencing decision.
According to CSNNE’s Tom Curran, when Kessler was asked whether he was suggesting that Goodell was going after Brady, he replied that, “He was out to protect [the investigation].” Prior to this, Kessler had made a point to mention that Goodell had spent $3 million on the deflategate investigation.
Curran believes that the judges seemed to side more so with the NFL in Thurday’s appeal meeting and Kessler’s comments were clearly not of benefit to Brady’s case.
Despite the explanations that Brady has personally made concerning his “destroyed” cell phone, the fact that Ted Wells did not initially even ask for the device, and the clearly sensationalized description of the situation by the NFL and media, the topic still appears to be an issue. Thursday’s appeal brought the subject back to the table of question. According to Curran, Judge Parker claimed that the issue “raised the stakes.”
“And Mr. Brady’s explanation made no sense whatsoever,” he said.
There is nothing quite like the issue of deflategate to get a Patriots fan all riled up. Between the accusations made against Brady and the fact that the case is still an ongoing topic, it all adds up to being ridiculous for the fans to witness.
Unfortunately, this leaves things up in the air for Tom Brady and leaves Patriots fans wondering, once again, if Jimmy Garoppolo will be in the quarterback position come this year’s season opener.
